1. Acceptance of Terms

By accessing or using Pack & Pally, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. These Terms form a legally binding agreement between you and Pack & Pally.

2. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account, make a booking, or host a trip. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and current.

3. Description of Services

Pack & Pally is a platform that connects travelers with trip hosts and helps you discover, plan, and book curated group adventures. We may facilitate bookings, payments, messaging, flight and accommodation search, and related travel features. We act as an intermediary and are not the provider of the trips, accommodations, activities, or transportation offered by hosts or third parties.

4. Accounts and Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, complete, and up-to-date information
• Keep your login credentials secure and confidential
• Be responsible for all activity that occurs under your account
• Notify us promptly of any unauthorized use of your account

We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or harmful activity.

5. Bookings, Payments, and Fees

When you book a trip or service, you agree to pay all applicable charges, including trip costs, service fees, and taxes as displayed at checkout. Payments are processed securely through third-party payment providers (such as Stripe), and by making a payment you also agree to their terms.

• Prices and fees are shown before you confirm a booking.
• A platform service fee may apply and will be disclosed at checkout.
• Where offered, partial-payment or installment plans are subject to the schedule shown at checkout.
• You are responsible for any bank, currency-conversion, or third-party charges.

A booking is confirmed only once payment (or the required deposit) has been successfully processed and you receive a confirmation.

6. Cancellations and Refunds

Cancellation and refund terms are set by the applicable trip or host and are presented to you before you book. Refund eligibility depends on the cancellation policy in effect for that booking. Service fees may be non-refundable. Please review the specific cancellation policy for each trip before confirming.

7. Hosts and Trip Listings

If you host trips or publish listings on Pack & Pally, you agree to:

• Provide accurate descriptions, pricing, itineraries, and availability
• Honor confirmed bookings and deliver the experiences as described
• Comply with all applicable laws, licenses, permits, and tax obligations
• Set fair and clearly stated cancellation and refund policies

Hosts are solely responsible for the trips and services they offer. Pack & Pally does not guarantee the quality, safety, or legality of any listing.

8. User Conduct

You agree not to:

• Use the Services for any unlawful, fraudulent, or harmful purpose
• Post false, misleading, offensive, or infringing content
• Harass, threaten, or harm other users, hosts, or travelers
• Attempt to circumvent payments or transact off-platform to avoid fees
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services

9. User-Generated Content

You retain ownership of the content you submit (such as reviews, photos, messages, and listings). By posting content, you grant Pack & Pally a non-exclusive, worldwide, royalty-free license to host, display, and use that content in connection with operating and promoting the Services. You are responsible for ensuring you have the rights to any content you post.

10. Intellectual Property

The Pack & Pally name, logo, software, design, and all related content are owned by Pack & Pally or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Services without our prior written permission.

11. Third-Party Services and Links

The Services may integrate with or link to third-party services (such as payment processors, mapping providers, and flight or accommodation partners). We are not responsible for the content, policies, or practices of those third parties, and your use of them is subject to their own terms.

12. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that any trip, listing, or third-party service will meet your expectations.

13. Limitation of Liability

To the maximum extent permitted by law, Pack & Pally and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill arising from your use of the Services or from any trip, booking, or interaction with hosts or other users.

14. Indemnification

You agree to indemnify and hold harmless Pack & Pally, its affiliates, and their respective officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Services, your content, or your violation of these Terms or applicable law.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk to Pack & Pally, other users, or third parties. You may stop using the Services and close your account at any time.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Pack & Pally operates, without regard to conflict-of-law principles. Any disputes arising from these Terms or the Services will be resolved in the courts of that jurisdiction, unless otherwise required by applicable law.

17. Changes to These Terms

We may update these Terms from time to time. Any changes will be posted here with an updated “Effective Date.” Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
